Детермінанти правового нігілізму військовослужбовців у системі законодавства: практичне дослідження

Вступ. У статті досліджується феномен правового нігілізму військовослужбовців Збройних сил України в умовах правового режиму воєнного стану. Актуальність теми зумовлена критичним зростанням випадків самовільного залишення частин (СЗЧ), що дестабілізує боєздатність підрозділів. Спираючись на концептуальні засади видового поділу правопорушень, автори аналізують недоліки чинного законодавства, які є ключовими детермінантами деформації правосвідомості комбатантів. Метою статті є обґрунтування необхідності переходу від репресивної кримінальної моделі до людиноцентристського адміністративно-сервісного підходу.
Методи. Дослідження базується на догматичному аналізі норм КК України та КУпАП, аналізі актуальної статистики СЗЧ і моніторингу правозастосовної практики. Використано порівняльно-правовий метод для оцінювання ефективності кримінальних санкцій порівняно з адміністративними стягненнями в контексті підтримання військової дисципліни.
Результати. Установлено, що чинна редакція ст. 407 КК України та ст. 172-11 КУпАП створює умови для "вимушеної криміналізації" військовослужбовців через відсутність гнучкої межі відповідальності в умовах воєнного стану. Критично проаналізовано норми закону № 3902-IX, де делегування командирам суб'єктивного права на звільнення особи від відповідальності визначено як чинник правового волюнтаризму. Запропоновано авторську концепцію "Smart-адміністративної відповідальності", що передбачає автоматизацію штрафів через цифрові екосистеми (Дія, Резерв+).
Висновки. Доведено, що системна недосконалість законодавства є первинною детермінантою правового нігілізму. Запровадження автоматизованих адміністративних процедур і реалізація територіального принципу комп-лектування дасть змогу не лише знизити рівень правопорушень, а й вивільнити значний кадровий ресурс право-охоронної системи для безпосереднього посилення фронту.
